Acceptance of Terms

Welcome to Sooth! These Terms of Service ("Terms") govern your access to and use of the Sooth mobile application (the "App") provided by Sooth ("we," "our," or "us").

By downloading, installing, or using Sooth, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

Sooth is a mobile application designed to help users track their progress in quitting smoking or vaping. The App provides features including but not limited to:

  • Nicotine-free day tracking and progress monitoring
  • Health recovery timeline and milestones
  • Money saved calculations
  • Craving management tools and SOS breathing exercises
  • Mood logging and journaling
  • AI-powered personalized insights (processed on-device)
  • Achievement badges and rewards
  • Home screen widgets

All your personal data is stored locally on your device. We do not operate servers that store your personal information.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding smoking or vaping cessation or any medical condition. Never disregard professional medical advice or delay seeking it because of information in the App.

No Guarantee of Results

While Sooth is designed to support your journey to quit smoking or vaping, we make no guarantees regarding the effectiveness of the App or that you will successfully quit. Individual results vary and depend on many factors beyond the App's control.

Health Calculations

The health improvement timelines, money saved calculations, and other statistics displayed in the App are estimates based on general research and the information you provide. These are approximations and should not be considered precise medical or financial data.

AI-Generated Content

Sooth uses Apple's on-device AI to generate personalized insights and reports. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. Do not rely on AI-generated content for medical decisions.

Your Data

All personal data you enter into Sooth — including your progress, mood logs, journal entries, and settings — is stored exclusively on your device. We do not have access to this data.

You are responsible for backing up your device if you wish to preserve your Sooth data. If you delete the app or lose your device without a backup, your data cannot be recovered.

Acceptable Use

You agree to use Sooth only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Attempt to circumvent any security features of the App
  • Use the App for any commercial purposes without our prior written consent
  • Redistribute or resell the App or any part of it

Intellectual Property

The App and its original content, features, and functionality are owned by Sooth and are protected by international copyright, trademark, and other intellectual property laws.

The Sooth name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sooth. You may not use such marks without our prior written permission.

Purchases and Subscriptions

Some features of Sooth may require a one-time purchase or subscription. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

  • Payment is charged to your App Store account upon confirmation
  • Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
  • Manage or cancel subscriptions in your App Store account settings
  • Refunds are handled by Apple according to their refund policies

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOOTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data stored on your device
  • Any damages arising from your use or inability to use the App
  • Any health outcomes or decisions made based on App information
  • Reliance on AI-generated content or recommendations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Changes to the App and Terms

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or restrict access to the App for any user who violates these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved in accordance with the dispute resolution mechanisms provided by the Apple App Store terms of service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sooth regarding your use of the App.
